Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("You", "User", or "Customer") and BLUESTARSYSTEM DI MONTICO JURI, a sole proprietorship registered in Italy ("BSS", "We", "Us", or "Our"), with registered office at Dorsoduro 2408/D, 30123 Venezia (VE), Italy, VAT number IT02342230303.

By accessing the Aura UI website at aura-ui.com ("Website"), creating an account, downloading, installing, or using any Aura UI software, components, or related materials ("Product"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Product or access the Website.

We reserve the right to update or modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Product after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

2. Account Registration and Responsibilities

To purchase Aura UI Pro or access certain features of the Website, you may be required to create an account. When registering, you agree to provide accurate, current, and complete information and to keep your account details up to date.

You are solely responsible for maintaining the confidentiality of your account credentials, including your password and any Composer authentication tokens or license keys issued to you. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

You are responsible for all activity that occurs under your account, whether or not you have authorized such activity. We will not be liable for any loss or damage arising from your failure to safeguard your account information.

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account and purchase a license.

3. License Grant

Aura UI is offered in two tiers: Free and Pro. Each tier is governed by different licensing terms as described below.

3.1 Free Tier (MIT License)

Aura UI Free is distributed under the MIT License. This means you are granted, free of charge, permission to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the Software, subject to the following condition: the above copyright notice and the MIT License permission notice shall be included in all copies or substantial portions of the Software.

The full text of the MIT License is included in the repository and reads as follows:

Permission is hereby granted, free of charge, to any person obtaining a copy of this software and associated documentation files (the "Software"), to deal in the Software without restriction, including without limitation the rights to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the Software, and to permit persons to whom the Software is furnished to do so, subject to the following conditions: The above copyright notice and this permission notice shall be included in all copies or substantial portions of the Software. THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.

The Free tier currently includes 26 Blade components. You may use these components in any personal or commercial project without limitation.

3.2 Pro Single Project License

Upon purchasing the Pro Single Project license, We grant you a non-exclusive, non-transferable, perpetual license to use the Aura UI Pro package ("Pro Package") under the following terms:

  • The license is granted to a single individual developer ("Licensee") for use in one (1) project.
  • A "project" means a single application, website, or product, regardless of the number of environments (development, staging, production) in which it is deployed.
  • The Licensee may install the Pro Package in unlimited development, staging, and production environments for that single project.
  • The compiled output (HTML, CSS, JavaScript) generated by the Pro Package may be deployed without restriction in the end-user application.
  • The source code of the Pro Package must not be redistributed, shared, sublicensed, resold, or made publicly available in any form, whether modified or unmodified.
  • To use the Pro Package in additional projects, you must purchase additional Single Project licenses or upgrade to the Unlimited license.

3.3 Pro Unlimited License

Upon purchasing the Pro Unlimited license, We grant you a non-exclusive, non-transferable, perpetual license to use the Pro Package under the following terms:

  • The license is granted to a single individual developer ("Licensee").
  • The Licensee may use the Pro Package in an unlimited number of personal and commercial projects, including projects developed for clients.
  • The Licensee may install the Pro Package in unlimited development and production environments, provided the Licensee is the sole developer using it.
  • The compiled output (HTML, CSS, JavaScript) generated by the Pro Package may be deployed without restriction in end-user applications.
  • The source code of the Pro Package must not be redistributed, shared, sublicensed, resold, or made publicly available in any form, whether modified or unmodified.

3.4 Pro Team License

Upon purchasing the Pro Team license, We grant your organization a non-exclusive, non-transferable, perpetual license to use the Pro Package under the following terms:

  • The license covers an unlimited number of individual developers within the same legal entity or organization ("Licensed Organization"). Seats are re-assignable: you may replace licensed developers over time without purchasing additional licenses.
  • All licensed developers must be employees, contractors, or members of the Licensed Organization.
  • The Licensed Organization may use the Pro Package in an unlimited number of personal and commercial projects.
  • The Pro Package may be installed in unlimited development and production environments belonging to or managed by the Licensed Organization.
  • The compiled output (HTML, CSS, JavaScript) generated by the Pro Package may be deployed without restriction in end-user applications.
  • The source code of the Pro Package must not be redistributed, shared, sublicensed, resold, or made publicly available in any form, whether modified or unmodified.

4. Restrictions

Regardless of the license tier you hold, the following restrictions apply to all use of the Pro Package:

  • No Resale or Redistribution. You may not sell, resell, lease, rent, or distribute the Pro Package source code, in whole or in part, as a standalone product or as part of any product that competes with Aura UI.
  • No Sublicensing. You may not sublicense, transfer, or assign your license to any third party. Each developer who uses the Pro Package must be covered by a valid license.
  • No Sharing of Credentials. You may not share your Composer authentication tokens, license keys, or account credentials with anyone outside the scope of your license. Single Project and Unlimited licensees must not share credentials with any other person. Team licensees must limit access to their licensed developers.
  • No Reverse Engineering. You may not decompile, disassemble, reverse-engineer, or attempt to derive the source code of any obfuscated or compiled portions of the Pro Package, except to the extent that such activity is expressly permitted by applicable law notwithstanding this restriction.
  • No Removal of Notices. You may not remove, alter, or obscure any copyright notices, license notices, or attribution contained in the Pro Package.
  • No Competing Products. You may not use the Pro Package source code to create, contribute to, or distribute a product that is substantially similar to or directly competes with Aura UI.

Violation of any of these restrictions constitutes a material breach of these Terms and may result in immediate termination of your license, in addition to any other remedies available to us under applicable law.

5. Payments and Refunds

5.1 Pricing and Payment

Aura UI Pro licenses are available for a one-time payment. There are no recurring fees or subscriptions. The current prices are:

  • Single Project License: €129 (one-time)
  • Unlimited License: €249 (one-time)
  • Team License: €699 (one-time)

All prices are in Euros (EUR) and are inclusive of applicable taxes unless otherwise stated at checkout. VAT may be applied based on your location and applicable tax regulations. We reserve the right to change pricing at any time; however, any price change will not affect licenses already purchased.

Payments are processed securely through Stripe. We do not store your credit card details on our servers. By making a purchase, you agree to Stripe's terms of service in addition to these Terms.

5.2 EU Right of Withdrawal (Digital Content)

Under Directive 2011/83/EU, consumers in the European Union have a 14-day right of withdrawal for purchases made online. However, as Aura UI Pro is digital content supplied on a non-tangible medium, the following applies:

Before gaining access to download or install the Pro Package, you will be asked to expressly consent to the immediate performance of the contract and to acknowledge that you thereby waive your right of withdrawal. This consent is required in accordance with Article 16(m) of Directive 2011/83/EU.

If you do not provide this consent, you will not be able to download the Pro Package immediately but will retain your 14-day withdrawal right.

5.3 14-Day Satisfaction Guarantee

Notwithstanding the withdrawal waiver described in Section 5.2, We offer a voluntary 14-day satisfaction guarantee. If you are not satisfied with the Pro Package for any reason, you may request a full refund within fourteen (14) days of your purchase date by contacting us at [email protected].

Upon issuing a refund, your license will be revoked and you must cease all use of the Pro Package, remove it from all projects and environments, and destroy all copies in your possession. Refunds are processed through the original payment method within ten (10) business days.

After the 14-day period has elapsed, no refunds will be issued, as the digital content has been fully delivered. If you experience technical issues that prevent you from using the Pro Package as described in the documentation, please contact us and We will make every reasonable effort to resolve the issue.

5.4 Invoicing

A compliant invoice will be issued for every purchase. For customers within Italy, invoices are issued in accordance with Italian electronic invoicing requirements (SDI). If you require a specific billing address or VAT number on your invoice, please provide this information during checkout or contact us promptly after purchase.

6. Intellectual Property

Aura UI, including all source code, documentation, design assets, trademarks, logos, and other materials associated with the Product, is and remains the exclusive intellectual property of BLUESTARSYSTEM DI MONTICO JURI. Your purchase of a license grants you the right to use the Product in accordance with these Terms; it does not transfer any ownership of intellectual property rights to you.

You retain full ownership of any code, designs, content, and other materials that you create using the Product. Nothing in these Terms grants us any rights over your projects, applications, or creative output. Your use of Aura UI components within your projects does not make your project code subject to our license terms.

The Aura UI name, logo, and related branding are trademarks of BLUESTARSYSTEM DI MONTICO JURI. You may not use these trademarks in a way that suggests endorsement, affiliation, or sponsorship without our prior written consent, except to accurately identify Aura UI as a dependency of your project.

7. Warranty Disclaimer

7.1 Free Tier

Aura UI Free is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall the authors or copyright holders be liable for any claim, damages, or other liability arising from the use of the Free tier. This is consistent with the MIT License under which the Free tier is distributed.

7.2 Pro Tier

For Pro license holders, we warrant that We will use reasonable commercial efforts to ensure that the Pro Package functions substantially as described in its documentation at the time of purchase. However, we do not warrant that the Pro Package will be error-free, uninterrupted, or compatible with all software environments or configurations.

To the maximum extent permitted by applicable law, except as expressly stated in this section, the Pro Package is provided without any additional warranties, whether express, implied, statutory, or otherwise. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall BLUESTARSYSTEM DI MONTICO JURI, its owner, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of or inability to use the Product, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any and all claims arising out of or relating to these Terms or your use of the Product shall not exceed the amount you actually paid to us for the license that gives rise to the claim. For users of the Free tier, our total liability shall not exceed zero euros (€0).

Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable law, including mandatory consumer protection rights under EU law.

9. Updates and Support

9.1 Free Tier

Aura UI Free receives updates on a best-effort basis. We may release bug fixes, improvements, and new features at our discretion, but we are under no obligation to do so on any particular schedule. Support for the Free tier is provided exclusively through community channels, including the GitHub repository's issue tracker and discussions.

9.2 Pro Tier

All Pro license holders (Single Project, Unlimited, and Team) are entitled to the following for a period of twelve (12) months from the date of purchase:

  • Updates: Access to all updates, bug fixes, and new features released for the Pro Package during the update period. Updates are delivered through the private Composer repository.
  • Email Support (Single Project & Unlimited): Direct email support at [email protected]. We aim to respond to support requests within five (5) business days.
  • Priority Support (Team): Direct email support at [email protected] with priority handling. We aim to respond to priority support requests within two (2) business days.

After the twelve-month period, your license remains valid and perpetual, and you may continue to use the last version of the Pro Package you received. However, access to new updates and support will cease unless you purchase a renewal.

10. Termination

We may terminate or suspend your account and access to the Pro Package immediately, without prior notice, if you breach any provision of these Terms, including but not limited to the license restrictions set forth in Section 4.

Upon termination for breach, your license to use the Pro Package is immediately revoked. You must cease all use of the Pro Package, destroy all copies in your possession, and remove the Pro Package from all projects and environments. Termination does not entitle you to a refund.

If your license is terminated by us without cause, or if we discontinue the Product entirely, your license to use the last version of the Pro Package you received shall survive termination in perpetuity, subject to the license terms and restrictions that were in effect at the time of purchase.

The Free tier, being distributed under the MIT License, is not subject to termination by us. Copies of the Free tier that you have obtained remain licensed under the MIT License regardless of any action we take.

Sections 4 (Restrictions), 6 (Intellectual Property), 7 (Warranty Disclaimer), 8 (Limitation of Liability), and 11 (Governing Law) shall survive any termination of these Terms.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Italian Republic, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or your use of the Product shall be submitted to the exclusive jurisdiction of the courts of Venice (Tribunale di Venezia), Italy.

If you are a consumer residing in the European Union, you are entitled to the protection of the mandatory provisions of the consumer protection laws of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU consumer protection legislation. You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

12. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.
